Are night vision rifle scopes illegal in california?
The Penal Code refers to a night vision rifle scope as a "sniper scope", and the restrictions regarding possession and use are outlined in section 468. I understand that as currently applied, only the military (like the state has any authority over them anyway) law enforcement or people doing legitimate, verifiable educational research can possess a night vision rifle scope. Simply owning one is considered illegal. It is also my understanding that it need not be designed to be a sighting device, but only that you have the means to attach it to a firearm. possession of them is not illegal. Hunting game animals at night with them is. I’d check with fish and game to see if you can varmint hunt with them. In some states you can take non game animals at night with them.
